OnSale allowed customers to order the HP TouchPad on their website and Amazon Store without telling them that they were out of stock. They waited over 36 hours to notify their customers that they would not be fulfilling majority of their orders. This entire time customers have had their form of payment pending and have been unable to free those funds.
It has now been almost 72 hours and many customers have still not received any notification from OnSale or Amazon about whether or not they will be fulfilled and still have pending charges for their orders. The only form of communication that the company has used to provide information is through Facebook. Many customers have tried to contact OnSale via phone or email, but many of their questions have been unanswered. Customers have been routinely hung up on or ignored intentionally.

I think people should at least demand interest for money OnSale held on to without notifying anyone of what was going on. It wouldn't be much but it would certainly be fair. A lot of people missed out on their chances to buy a Touchpad thanks to OnSale's incompetence.The least they could have done was cancel orders in a timely matter instead of leaving people waiting and wondering.

In this case OnSale (Seller), us (Buyer), confirmation email that the order will be shipped soon (Agreement) & credit card charge (Monetary exchange). So legally they are required to provide us the item at the agreed to price.
If they have to buy the item at the current price and then sell it to at $99 (or $149) so be it. This is the risk you take when you do business.

I am very angry and upset that they gave me false expectations, stealing from me the opportunity to purchase the item elsewhere and taking my sensitive financial information at a time when their site was obviously not properly working. There are many remedies for onSale's inept web-site including accurate inventory control and load-testing and I hope they address these problems immediately, although I certainly will not use onSale again and as well I do not plan to return to Amazon as a customer either I unless I receive a proper apology and a commitment from Amazon that onSale will be thoroughly investigated and removed from Marketplace.
Oddly enough, Amazon replied that they will investigate onSale, but they indicated they will not release the outcome of the investigation. What? We the customers that have been mistreated deserve to know the outcome!!

1 - OnSale charged my card for the sale of a product it did not have.
2 – The situation was immediately recognized by their management, yet 3 days past before receiving any type of notification.
3 – Once I did receive a notification, it simply stated “order canceled”.
4 – At NO POINT should a customer receive information via internet forums before directly from the business they interacted with.
Because they waited 3-4 days to cancel orders and communicate, and because they had touchpads available for a higher price shortly before and after canceling many of the orders....many people feel like there was bad faith on the part of onSale, and want the seek out a remedy from the courts.
