Let me tell how I, a small business entrepreneur, was raped by American Family Insurance Company. I invite you to share your comments of unethical insurance practices in America by signing this petition.
In 1997, I offered Farmers Insurance Group (FIG) a solution for “Redesigning Insurance Claim Practices in the Age of Networking.” My company V3W (Velocity in the Third Wave) facilitated a pilot project to design an interactive business management approach to coordinate the commitments in the value chain of stakeholders in insurance claims processing. The stakeholders included leadership, management, agents, adjusters, contractors, vendors, and service professionals. FIG primary objective was to improve the claims process effectiveness and ensuring policyholder’s customer satisfaction. FIG had committed to a noble endeavor for an insurer that had over 25% market share.
The pilot V3W B2B project was abruptly curtailed when my company encountered a liability claim with my insurer American Family Insurance Company (AFIC) in May 1999 that resulted in six years of tortuous malicious litigation. I was sued for $1.3 million by sub contractors who testified to AFIC outright breach of contract. AFIC was a 3rd party defendant in the litigation. AFIC had an obligation and responsibility in the liability policy to provide an independent legal representative to my company. AFIC inappropriately, unethically, and deceitfully provided effectively an in-house insurance litigator Harris, Karsted, Jamison & Powers (HKJP) to defend AFIC financial interests and ignore conflicting documented evidence in a breach of contract. HKJP responded to motions in court without even talking to me and represented solely the financial interests of AFIC.
I sued AFIC/HKJP for Bad Faith in Denver District Court Case No: 03CV1306, and the litigation were concluded on the courthouse steps on May 2005 with no confidentiality to any party. As a small business entrepreneur I was absolutely indignant with the legal raping discovered over a six year period where lawyers profit for fun on human misery. Operating under the public radar AFIC/HKJP were committing civil conspiracy in a confidential proprietary electronic business scam that undermined the ethical trust of policyholders in claims processing.
AFIC/HKJP operated a secret communication electronic linkage as a confidential business practice on case management files. HKJP concealed my company’s Liability Case Management File from my own personal attorney. AFIC/HKJP maliciously concealed confidential employment records of AFIC commercial adjuster Sam Amigo for six years. Finally through a court order the file was released and Sam Amigo provided a sworn affidavit in April 2005 confirming AFIC causation/liability in the breach of contract where AFIC authorized my company to mitigate an emergence asbestos spill at the Atrium Condominiums in Denver Colorado.
This professional conduct is outrageous criminal behavior that literally raped individuals and small business people in Colorado. AFIC/HKJP have no viable ethical justification for such professional conduct and at a minimum every lawyer involved should have been disbarred. I continued my formal complaint to the Colorado Division of Insurance and Colorado Supreme Court. Absolutely nothing happened to address the criminal practice. Let the record of both institutions speak for itself, regarding the unethical collusion of state oversight authorities, in caring for the community good. In my assessment this is our denied problem as citizenry and why we no longer trust institutional governance and oversight.
I submit professional elite corporations everyday conceive unethical confidential proprietary business practices concealing business processes in consumer transactional configurations that exploit financial prosperity for their shareholders while abusing the basic ethical trust necessary to have a healthy society. No owner of any enterprise ever has the right to abuse consumers’ person in unethical monopolistic power. Yet, we are mired in it and the new grand scheme for a congressional debt reduction plan is to drastically cut Medicare/Medicaid through a federally subsidized private insurance program! Alarm bells go off in my body and I want to scream, “bloody murder.”
My honest assessment is AFIC/HKJP are bottom feeders in the insurance industry and I am committed to see them ran out of business for our community good.
WE ARE REQUIRED BY LAW to purchase insurance in this American monopoly game. We pay premiums promised Utmost Good Faith for unforeseen losses driving a car, owning a home, running a business or a sudden illness. We file a claim, and the claim is either rejected outright due to hidden legal limitations, premiums are increase, or the policy is simply canceled. We suffer unjustly in the current insurance standard practices. State statues require litigation where lawyers have a hey day abusing our civil liberties as persons, taxpayers and small business entities. The Insurance Industry is so powerful they influence election of political leadership, manufacture laws in federal/state legislators, appoint managing governmental oversight authority, and control the jurist prudence decisions in the American Justice System. Houston we have a problem!
The compelling reason to sign this Groubal Complaint is to change our commitment to caring for OUR AMERICAN FAMILY FIRST as a people who deeply care for one another. As Americans spend more on litigation in the jurist prudence system than on total R&D every year and that is a shame. Lawyers (politicians) need arrested for designing corporate monopolies that enslave our people in robotic transactional configurations serving financiers on Wall Street.
SHARE YOUR HONEST ASSESSMENT regarding standard insurance claims practices. IF you are exhausted, sick, tired of current polarized special elite ownership interests who basically don’t care if you live or die, share your outrage and indignation, and what to do to solve the problem as a person?
Let’s take back control of our personal and collective checkbook(s) put an end, once and for all, to the high-risk greed of financiers, bankers, insurers, and politicians in America. We don’t need insurance. We must learn to care for one another’s health and well being in solidarity to thrive as an American people regardless of the uncertainty and changes in an emergent new world. Let us join together in designing our future as an ethical citizenry.
Finally one last note, I served in the US Army ’68 to ’70 and was a 30% service connected disabled American veteran in 1999. The emotional drama and trauma of this corporate battlefield awarded me a VA benefit of 100% permanent service connected disability. It turns out the competitive (un) intelligence in boardrooms is actually a greater threat to our national security than what is happening on the battlefields around the world.
If I am unemployable in our current condition and situation we are in a hopeless situation. I never signed up to protect and defend such outrageous leadership behavior and I am committed to see it change so my grandchildren and future generations can inherit a world that cares, feeds and nurtures personhood as an ethical standard.
The expert damage report in the Bad Faith case declared the V3W solution was viable, never tried in the marketplace, and conservatively estimated a $26 million business loss at 10% shareholder value. I owned 100%. I intend to go back to work and fix the hole in my bucket. Together in solidarity we can learn how to design pro consumption in shared services as an ethical citizenry that cares for our common good in a mood joyful concern.

Without generalization, there are examples of claims that have been handled very professionally, and those that I literally could not believe the lack of ethical behavior that the policyholder was victim to.
From my experience, this is often due to the personalities involved with the claim, which can severely effect the direction, and good faith (or lack thereof) in the fair resolution and indemnification.
Unfortunately, the "Deny, Delay, Defend" works very well when a company of virtually limitless resources is put against an individual with limited means. The success if this tactic keeps it as a common weapon in the battle of the 'claim', which the only defense is the casualties of many, and the determination of the total sum of individuals who combine resources (i.e. class action) against such leverage.
One should remember that attorneys are also the ones who policyholders look to at beating the carrier at their own game, and the actions of some should not represent the actions of all. I can promise you that some of them, are indeed your allies.

In that time, I have filed 1 claim on 2 of the properties and 2 claims on my personal home, with no claims ever being filed on the other 4 homes! We had a hail storm in Phoenix that affected my AC unit, and I have been battling with AmFam since March 2010
to have it replaced. Five HVAC cos. have all said it will never again operate at 100 percent. As of yesterday, the adjuster said "no, we will not replace it because it's too old."
They told their 5th HVAC co. it was because the coil wasn't damaged.
Until we find employees within these dishonest corporations who are willing to testify as to their corruption, we're
screwed!
